What is the Whistleblower Protection Act?

The House for Whistleblowers Act came into effect on 1 July 2016. The House for Whistleblowers is an independent body that acts as a central reporting point for whistleblowers. The aim of the House for Whistleblowers is to protect whistleblowers and investigate reports of abuses within organisations. As of 18 February 2023, the House for Whistleblowers Act will be called the Whistleblower Protection Act. All employers with 50+ employees are required to have an internal reporting scheme for reports of abuses.

Whistleblower protection

The Whistleblowers Protection Act offers various protection measures for whistleblowers. For example, it is prohibited to disadvantage or dismiss a whistleblower for reporting an abuse. Whistleblowers have the right to anonymity and their identity must be kept confidential, unless the whistleblower gives permission to be known. In addition, there are arrangements for legal protection and compensation for any damage the whistleblower has suffered as a result of the report.

Rights and obligations for employers

Employers also have rights and obligations under the Whistleblower Protection Act. For example, they are obliged to draw up an internal reporting procedure that describes how employees can report abuses and how the organisation deals with these reports. In addition, employers must ensure a safe and confidential reporting environment and may not disadvantage or discriminate against whistleblowers because of the report. Failure to comply with these obligations can lead to legal consequences and reputational damage for the organisation.

Whistleblowers Protection Act and the Confidential Counsellor:

A confidential counselor plays an important role in the whistleblowing policy within organisations. The confidential counselor acts as an independent point of contact for employees who want to report abuses and offers support, advice and guidance during the reporting process. The law states that a 'confidential counsellor' must be appointed to whom employees can report confidentially. Filling the role of this confidential counsellor with a confidential counselor is recommended by the House of Whistleblowers as an integrity provision within organisations.

Apply legislation in practice

Implementing the House for Whistleblowers Act in practice requires attention and careful planning. Here are some tips for applying the legislation effectively:

  1. Develop a clear whistleblowing policy with an internal reporting procedure for misconduct: Draw up a policy that sets out the procedures for reporting misconduct, the protection of whistleblowers and the role of the confidential counselor.
  2. Ensure a safe reporting climate: Create a culture in which employees feel safe to report abuses and in which confidentiality and non-retaliation are guaranteed.
  3. Appoint a confidential counselor: Appoint a confidential counselor who acts as a point of contact for whistleblowers and supports them throughout the entire reporting process.
  4. Communicate and train employees: Inform employees about the whistleblowing policy, the protective measures and the importance of integrity. Offer training to raise awareness and inform employees of their rights and obligations.
  5. Evaluate and improve the policy: Conduct regular evaluations to assess the effectiveness of the whistleblowing policy and make adjustments where necessary.
