As of February 1, an important change has been implemented for whistleblowers in the Netherlands and free legal support is available for whistleblowers. Thanks to a new scheme, set up by the State Secretary for Kingdom Relations and Digitalization, the Minister for Legal Protection, and the House for Whistleblowers, whistleblowers can now claim free legal assistance or mediation. This development is an important step in strengthening the position of whistleblowers and guaranteeing their legal protection.

The importance of free legal support for whistleblower
This arrangement was created to better enable whistleblowers to enforce their legal protection. The initiative recognizes the challenges and risks whistleblowers often face when exposing wrongdoing. By offering free legal support, the threshold for reporting social abuses is lowered.
How does it work?
Whistleblowers who wish to make use of this scheme can contact the House for Whistleblowers. The Advisory Department of the House assesses whether there is a reasonable suspicion of social abuse, as defined in the Whistleblowers Protection Act. If legal support is necessary, the whistleblower will receive a referral letter for legal assistance and/or mediation. This letter provides access to subsidized legal assistance through a lawyer or mediation, without an income or assets test or a personal contribution being requested. This is arranged in the Legal Aid Subsidy Scheme. Whistleblowers Protection Act
Social importance of whistleblowers
This arrangement underlines the social importance of whistleblowers and the need to protect them. State Secretary Van Huffelen and Minister Weerwind emphasize that reporting abuses requires courage and that whistleblowers should not be left alone in their struggle. The hope is that with the introduction of free legal assistance and mediation, more people will feel empowered to stand up against injustice.

Who is this scheme for?
The scheme is not only open to (potential) reporters of abuses, but also to involved third parties and people who assist the reporter. This broad reach ensures that everyone who is directly or indirectly involved in reporting an abuse can be supported.
Future evaluation of free legal support for whistleblower
The scheme has a term of four years and will be evaluated after two years. This evaluation will provide insights that can be used to further optimize legal support for whistleblowers.
Ready to see how Snowflake works?
The introduction of free legal support for whistleblowers is a significant advance in protecting those who expose wrongdoing. It shows a clear recognition of the value of whistleblowers to our society and the need to protect their rights and well-being. This arrangement sends a strong message: whistleblowers are not alone.
